Terms and Conditions

The following information governs access to and use of the website www.colchonesmalaga.com, as well as the purchase of products through it. By placing an order, the customer declares that they have read, understood and fully accepted these terms and conditions.

1. Purpose and Scope of Application

These Terms and Conditions set out the general conditions governing the relationship between Colchones Málaga (hereinafter, “we”) and the users and customers (hereinafter, “the Customer”) who access and make purchases through our website.

2. General Conditions of Sale

• Prices and Products: The prices of the products published on the site are shown in euros and include VAT and delivery costs, unless otherwise stated. We reserve the right to change prices at any time, without this affecting orders that have already been confirmed.
• Payment Methods: We accept payment by bank transfer, credit card and other methods indicated in the “Payment Methods” section. In the case of card payment, the process will be considered complete once the purchase has been finalised.
• Order Confirmation: Once the order has been placed, the Customer will receive a confirmation email with the details of their purchase.

3. Shipping Policy

As a general rule, parcels are shipped 2 to 12 working days after receipt of payment, through our carrier with a tracking number. We will provide a link so you can track your order online. Delivery is free of charge and includes handling and packaging costs.

• Deliveries with Assembly: For products that require assembly (for example, ottoman storage beds), delivery and assembly costs are included, with a delivery time of 10 to 20 working days (usually shorter), as the assembly team needs access to the inside of the property to carry out the assembly.
• Delivery Times: Delivery times start counting from the day the transfer or deposit corresponding to payment for the order is received in our bank account. In the case of card payment, it will be counted from the moment the purchase is completed. All the times indicated refer to working days (Monday to Friday, not including public holidays).
• Order Processing: If payment is made by deposit or transfer at one of the banks indicated in “Payment Methods”, the order will be processed immediately. For transfers from other banks, the transaction may take up to 48 working hours to become effective after it is made.
• Delivery: Delivery will be made to the customer's door. The carrier will make deliveries Monday to Friday (morning or afternoon) and Saturday mornings. During the delivery period, we will stay in contact with the customer until the order arrives at their home.

4. Returns Policy

1. RETURNS:
   Once the customer has received their order, they may withdraw from the purchase only if:
   • The goods are broken or show some defect.
     Outside of this case, withdrawal from the purchase is not accepted, provided that the product has not been used and is in its original packaging, within a maximum period of 7 days.
   • The customer must inform us by email, stating the order number and attaching a photograph of the defective product.
2. IN THE CASE OF A REFUND:
   If the product is returned within 2 days (as evidenced by the postmark) of delivery to the customer's home, COLCHONESMALAGA.com will process the refund in cash by bank transfer (transfer costs will be borne by the customer), in the case of payment by credit card. We undertake to make the refund as soon as possible.

5. Intellectual Property

All content on the website, including text, images, designs, logos and other elements, is the property of Colchones Málaga or of third parties who have authorised its use. Reproduction, in whole or in part, without prior authorisation is prohibited.

6. Liability and Warranties

• Liability:
  We undertake to provide our services with the utmost care, but we will not be liable for delays or failures arising from causes beyond our control (force majeure, network problems, transport delays, etc.).
• Warranties:
  Products come with the legal warranty established under current regulations. For any issue, the Customer should contact our customer service team.

7. Data Protection

The collection and processing of personal data will be governed by our Privacy Policy, which forms an integral part of these Terms and Conditions.

8. Amendments and Validity

Colchones Málaga reserves the right to amend these Terms and Conditions at any time. Amendments will take effect from the moment they are published on the website, so customers are advised to review them periodically.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. In the event of a dispute, the parties submit to the Courts and Tribunals of the city of Málaga, unless the law provides otherwise.
