Terms and Conditions

The following information governs access to and use of the website www.colchonesmalaga.com, as well as the purchase of products through it. By placing an order, the customer declares to have read, understood, and fully accepted these terms and conditions.

1. Purpose and Scope of Application

These Terms and Conditions establish the general terms that govern the relationship between Colchones Málaga (hereinafter, “we”) and users or customers (hereinafter, “the Client”) who access and make purchases through our website.

2. General Terms of Sale

  • Prices and Products: Product prices published on the website are expressed in euros and include VAT and shipping costs, unless otherwise stated. We reserve the right to modify prices at any time, without affecting orders that have already been confirmed.
  • Payment Methods: Payments are accepted via bank transfer, credit card, and other methods indicated in the “Payment Methods” section. In the case of payment by card, the process will be considered complete once the purchase has been finalized.
  • Order Confirmation: Once the order has been placed, the Client will receive a confirmation email with the details of their purchase.

3. Shipping Policy

As a general rule, packages are shipped within 2 to 12 business days after payment is received, using our own carrier with tracking number. We will provide a link so you can track your order online. Shipping is free and includes handling and packaging costs.

  • Deliveries with Assembly: For products that require assembly (e.g., ottoman beds), shipping and assembly costs are included. Delivery is made within 10 to 20 business days (usually sooner), as our assembly team needs to access the inside of the home to complete the installation.
  • Delivery Times: The delivery period begins from the day the corresponding payment is received in our bank account. In the case of card payment, the delivery period will begin once the purchase is completed. All stated delivery times refer to business days (Monday to Friday, excluding public holidays).
  • Order Processing: If payment is made via deposit or transfer to one of the banks listed in the “Payment Methods” section, the order will be processed immediately. For transfers from other banks, the transaction may take up to 48 business hours to become effective.
  • Delivery: Delivery will be made to the customer’s doorstep. The transport agency will carry out deliveries from Monday to Friday (morning or afternoon) and on Saturday mornings. During the delivery period, we will remain in contact with the customer until the order arrives at their home.

4. Return Policy

  1. RETURNS:
    Once the customer has received their order, they may withdraw from the purchase only if:
    • The item is damaged or has a defect.
      Outside of this case, withdrawal from the purchase will not be accepted unless the product has not been used, remains in its original packaging, and the request is made within a maximum period of 7 days.
    • The customer must notify us via email, indicating the order number and attaching a photo of the defective product.
  2. IN CASE OF A REFUND:
    If the product is returned within 2 days (as evidenced by the postal stamp) from the date of delivery to the customer’s home, COLCHONESMALAGA.com will issue a cash refund via bank transfer (transfer fees will be borne by the customer), in the case of payment by credit card. We are committed to processing the refund as quickly as possible.

5. Intellectual Property

All content on the website, including texts, images, designs, logos, and other elements, is the property of Colchones Málaga or of third parties who have authorized its use. Total or partial reproduction without prior authorization is strictly prohibited.

6. Liability and Warranties

  • Liability:
    We are committed to providing our services with the utmost diligence, but we shall not be held responsible for delays or failures caused by circumstances beyond our control (force majeure, network issues, transport delays, etc.).
  • Warranties:
    All products include the legal warranty established by current regulations. For any issue, the Client must contact our customer service team.

7. Data Protection

The collection and processing of personal data will be governed by our Privacy Policy, which forms an integral part of these Terms and Conditions.

8. Modifications and Validity

Colchones Málaga reserves the right to modify these Terms and Conditions at any time. Modifications will take effect upon their publication on the website; therefore, customers are advised to review them periodically.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. In case of dispute, the parties submit to the Courts and Tribunals of the city of Málaga, unless otherwise provided by law.
